Completion of the Easy-Earn Affiliate Registration form and purchase
of at least one ValuePak shall signify full acceptance of these
Terms & Conditions of Service.
Easy-Earn reserves the right to change and/or amend these Terms
and Conditions of Service at any time without prior notice.
Terms
The term "Easy-Earn" refers to the business operated
from the website at the URL http://www.easy-earn.biz, the program
promulgated there and the website owners.
The word "program" refers to the Easy-Earn program as
outlined on the Easy-Earn website.
The word "affiliate" refers to any person who has been
approved for participation in the program by purchasing a ValuePak and
consequently becoming an approved affiliate, or agent, allowing
him/her to earn commissions on sales that result from his/her referral
of people to the program (and the ValuePaks) and those of
his/her affiliates and his/her sub-affiliates.
The term "affiliate tree" or "commission tree" refers
to the hierarchical three-level commission structure as it applies
to any affiliate. All affiliates therefore occupy the top level
of their own affiliate tree. Level One Commissions are
payable to the top level affiliate on all purchases made by the
people they directly referred to the Easy-Earn program. Such people
then become his/her affiliates, i.e. they operate directly under
the top level affiliate in the affiliate tree, on Level One. Level
Two Commissions are payable to the top level affiliate on all
purchases made by the people their affiliates referred.
Such people then become his/her Level Two affiliates (or
sub-affiliates). Level Three Commissions are payable to
the top level affiliate on all purchases made by people directly
referred to the Easy-Earn program by his/her sub-affiliates.
"Downline" refers to all members of an affiliate tree
(through three levels).
"Upline" is the reverse of a downline. In other words,
it consists of the affiliate under whom they joined, plus the affiliate
under whom they joined, plus the top level affiliate of
that 'upline tree.'
The terms "Package" or " ValuePak" refers
to those ebook and software collections designated as such plus any
software or ebooks or any other digital products or services that
may be added from time to time, as well as any changes, substitutions,
additions or removals and suchlike as may be deemed necessary by
Easy-Earn.
ValuePaks are graded according to value. "Bronze" ValuePaks are
priced at $7.00, "Silver" at $14.00, and "Gold" ValuePaks sell
for $21.00.
Affiliates are also graded according to the highest value ValuePak they
own. "Bronze" affiliates therefore own one or more Bronze ValuePaks,
but on purchase of a Silver ValuePak would immediately become
a "Silver" affiliate. Likewise, to become a "Gold" affiliate
one would need to own a Gold ValuePak.
All dollar signs denote values in US dollars.
Conditions
Easy-Earn
Easy-Earn reserves the right to investigate all complaints regarding
the use of any information provided by Easy-Earn, and to take whatever
action is deemed appropriate if any violations of these Terms & Conditions
of Service become apparent.
Easy-Earn reserves the right to be the sole arbiter and interpreter
of these Terms & Conditions Of Service in the event of a disagreement
regarding their meaning.
Easy-Earn accepts no responsibility for any changes, omissions,
or alterations made in respect of the program or of information
contained in any emails sent by Easy-Earn or published on the Easy-Earn
website howsoever such changes, omissions, or alterations may affect
affiliates of Easy-Earn.
Easy-Earn does not in any way endorse, or vouch for the contents
of any documents, emails or websites created by or for affiliates
of Easy-Earn.
ValuePaks
There are a number of individual digital products in the ValuePaks,
and it would be virtually impossible for Easy-Earn to reclaim those
goods or the intellectual properties involved. Therefore, refunds
will not be undertaken except when exceptional circumstances
are involved. However, all legitimate requests will be given due
consideration provided the proper steps are completed as follows:
The request must be lodged by using one of the Contact Forms
provided within the Member Area within 30 days of purchase;
The reason for the request must be clear and unambiguous;
Any extenuating circumstances must be spelt out in detail;
An undertaking must be included to the effect that no further
use, no matter how small or unintentional, will ever be made
of any of the components within any ValuePak;
It must include an acknowledgement that Easy-Earn has the right
to take legal action in respect of any breaches of faith regarding
the aforementioned undertaking.
Many items within the ValuePaks include Full Resale Rights.
However, there are a few to which this doesn't apply and some Resale
Rights terms vary. It is the responsibility of the individual to
read and comply with all Resale Rights including any restrictions
for individual products.
Affiliates
No affiliate or past affiliate may pass on any information received
as a result of their affiliation to any third party in any form
whatever or by any mode of transmission whatever.
No affiliate or past affiliate may copy the program or any part
of it or adapt it for use with any other venture without permission.
Easy-Earn reserves the right to resort to legal action in the event
of such a breach of these terms.
Registration of information via the forms provided for the purpose
are a requirement of affiliation and affiliates are wholly responsible
for keeping their information up to date.
Understanding the importance of retaining a registered email address
and of updating any information in respect of any email addresses,
including those associated with any payment processors, will be
assumed and is the affiliate's responsibility. In the event of
any registered email address becoming inoperable, Easy-Earn may
need to replace it with one of their own choosing in order to ensure
the viability of a downline.
Registration of affiliation will be assumed as agreeing that their
(the new affiliate's) registered email address may be included
on a list of email addresses the owners of which volunteer to be
the recipients of emails from their upline. Such inclusion automatically
requires that they too agree to be such a recipient.
All affiliates may communicate with their downline members (i.e.
their affiliates, their sub-affiliates and their sub-affiliates'
buyers) and may record their email addresses for such purposes.
All such communications must include an opt-out address and instructions
for resigning from such mailing list. All opt-out requests or resignations
must be acknowledged promptly and their details removed from such
list completely. Any attempt to communicate with anyone so 'opting
out' shall be considered thenceforth to be spam.
Affiliates may promote the program using any legitimate means
they choose, always provided that they do so on the understanding
that Easy-Earn cannot be held liable for any of their statements
nor shall it be bound by them.
The use of unsolicited promotional emails or messages (also known
as 'spam'), to promote the program is absolutely forbidden. Easy-Earn
defines spam as emails or messages about the program sent to people
not known by the sender and who have not specifically asked for
information regarding it. Anyone found promoting Easy-Earn this
way will immediately be barred from any further participation without
right to refund.
Attempts to circumvent the smooth operation of the program or
to gain an illegitimate advantage are forbidden. Anyone found guilty
of offending in this or in any similar way will be barred from
further participation in the program and may find themselves subject
to legal action.
Although every effort has been made to provide timely and accurate
information, Easy-Earn shall have no liability to any person or
entity with respect to loss, or damage caused or alleged to be
caused directly or indirectly by any information contained in any
emails or read on any Easy-Earn sales page or website nor in any
emails or on any websites owned by affiliates Easy-Earn.
Commissions
Bronze affiliates earn $1.00 on
each and every sale made through their own links (Level
One commissions), $2.00 on sales made by their affiliates (Level
Two commissions), and $3.00 on sales made by their sub-affiliates
(Level Three commissions).
Silver affiliates commissions are
the same as bronze affiliates except that any sales of Silver or
Gold ValuePaks earn them double the bronze commissions.
Gold affiliates commissions are
the same as Silver affiliates except that any sales of Gold ValuePaks
earn them triple the bronze commissions.
